A wayleave agreement will be needed.

Quote "When do we need a wayleave?

We need to have a wayleave agreement in place to install or repair Openreach equipment on private land, or inside a property, where it provides service to people who aren’t the legal owner of the land or a property, such as an apartment building.

I did read the wayleave form, but it sounded more for a block of flats.

I live in a house with existing service, i just need an upgrade. You think the wayleave still applies?

Thanks for this.

I feel like i've been given the run around possibly from Openreach about this. Is 2nd hand verbal permission sufficient do you think or a should i ask my landlord to write something down or email?

I doubt you would have had an issue the first time if you had that as it would have been difficult for the engineer to argue over written permission.

Openreach will need permission, as you do not own the property, and they will not proceed without it.

If its a full fibre connection, then there is additional work to be done, which will involve holes being drilled in the wall, and an external box fitted. Some landlords do not want this, which is why Openreach need a formal agreement.

I already have a live service through holes already in the walls. I already have verbal permission from the landlord for the upgrade.

I can see there's an online wayleave form, which does not seem relevant for my situation.

I was kind of hoping someone might link me to a form that would be appropriate for me. But it doesn't seem like that's the case.

Thanks for everyone's input here. I'm not sure how official all that is. But i'll ask for written permission and i'll pass that on.

The only time permission like this is required for regular dwellings is if some other private property is involved, so ( for arguments sake ) a terrace of houses , where there is a wall block on one end , and to get to your property the cable would have to go across the property’s in-between the wall block and you , if the cable is entirely on your property, even if it’s rented , it’s can be assumed ( deemed consent) that you have already obtained permission from your landlord, Is there possibility they would refuse ?, in fact unless you told the installer it’s a rented property how could they know ?

If it’s apartments , there can be complex permissions, if there isn’t already internal distribution installed ..what sort of service are you getting , copper ( FTTC or ADSL ) or is it FTTP ?

Is it possible for the new FTTP to ‘follow’ the existing copper service , so if overhead feed , where the copper dropwire attaches , the fibre dropwire would use the same attachment on the wall , if underground ducted , then the fibre would be installed alongside the copper cable in the existing duct, neither of these situations needs any ‘wayleave’ or extra permission

If the area was underground fed , but not ducted , the existing copper cable would be ‘DIG’ , direct in ground, the usual method to provide FTTP service in these cases is for a new ‘Toby’ box to be fitted in the footpath opposite the address, if/when service ordered , the fibre cable needs to be installed in the ground between the toby box and house wall…OR try to put the toby box in such a position so that it’s the easiest route to the house wall , normally they aim for a soft dig through grass , but if someone had ( for example ) paved the entire front garden area of their property , obviously there wouldn’t be a soft dig available, and ‘permissions’ would be needed to excavate the ‘paving’ , was the issue anything like this ?

The DSL checker will show what type of service OR should expect ( 1 or 2 stage , no anticipated issues , or potential problems ) can you post the full return for the address , including the info below the speeds available ,

https://www.broadbandchecker.btwholesale.com/#/ADSL
