Got Bt Infinity installed yesterdat here are my stats

 

1. Best Effort Test: -provides background information.

 Download Speed
 37.36 Mbps

Max Achievable Speed

 

 Download speedachieved during the test was - 37.36 Mbps

The modem reserves 1Mb of upload for QOS.

Yes your stats are fine,because you are getting a download reading of approx 37Mbps from a 38Mbps line profile,and also the same with the upload as on upload testing you are getting a reading of 8Mbps approx from a 10Mpbs profile.:)

Additionally you would also lose some speeds(although not much), as you are using your connection to test it.
