If you look at the videos of the speedtest he has, you can see the speed how the speed flutuates, this indicates errors on the line that the modem is trying to compinsate for.
It is only UP TO in the sense it is UP TO and no more than 76Mb, the service you are sold is not UP TO anything it is plainly stated as SHOULD be X up, Y down and GENERALLY within +/- 1 or 2Mb of X up,Y down.
Not as people would have you believe UP TO the figures sold!!!
Your entitled to your opinion.
So now you should be able to go to a county court and get your 76Mb +/-1 or 2Mb.

You are missing the point, I was sold 48.9Mb down 10.9Mb up not 76Mb down 20Mb up hence I do not expect 76Mb down 20Mb up.
As I said the service is up to 76Mb but in reallity it is sold to me as a definitve level of 48.9Mb down, 10.9Mb up which I do expect i.e. In my case I SHOULD get 48.9Mb GENERALLY within +/- 1 or 2 Mb, it does not state UP TO 48.9Mb.
As I've said countless times if you are happy to pay for something you are promised then don't receive then I'm really happy for you, just don't bang on at people who are not in the same frame of mind.
