Could someone explain this ? bad company practice

I got a contract with BT for Infinity 1 with a new line install, everything was fine i was getting the top speed offered by the package witch was 52 Mb/s. After a couple of months i received an offer to upgrade to Infinity 2 (up to 72 Mb/s) witch i did  but the top download speed was 39 Mb/s. Now i let 10 days pass thinking it would take sometime to adjust but nothing change i opened and issue and was told that everything was fine and i was getting the minimum speed guaranteed witch is 35 Mb/s and this got my contract renewed by 12 months to end PAYING MORE FOR LESS. After a month i decided to downgrade back to Infinity 1 in hopes to at least get back to my speed of 52 Mb/s but without any luck. Now i'm getting 35-39 Mb/s with a new 12 months contract and i pay more than my first contract with Infinity 1. Is this BT company practice and scamming people ?

Your line will not support Infinity 2 speeds as you are too far away from the cabinet. You are within the estimated speed range for Range A.

Did you check what you were likely to get, before you agreed to upgrade?

 

Can you please post the connection speed reported by your home hub?

 

Please can you provide http://speedtest.btwholesale.com/  results including the further diagnostics page?

 

This must be done using a computer connected to the home hub, using an Ethernet cable.
