At the end of my tether- CCJ

My son discovered he has a CCJ after moving out of a property. This is in no way to excuse what’s gone on, his relationship broke down he got himself a Coke habit and did some sofa surfing. Through hard work he’s in a much better place and clean and he discovered the CCJ when he tried to rent a house when he got a new job. He has called BT to try and pay and sort but they told him they had passed the debt on - he contacted the debt agency and they said they no longer had an interest in the debt and sent him an email to say so. So here he is trying hard to rebuild his life and trying to pay his debts but it is proving very difficult. I know it shouldn’t be easy when you owe money but should it be so difficult to sort things out - can anyone give us some assistance on how we move forward in trying to clear the debt. Non of us have experience of CCJs and when we discovered the CCJ we obtained a copy of the record from the courts but not a full copy of the CCJ so ATM we just have a case number. He’s at his wits end trying to sort.

The County Court will tell your son how much the judgment debt is for and BT should be able identify the debt collector used.  Once the debt is paid in full an application is made to the Court for a Certificate of Satisfaction.  Don't expect to be able to do all of this within 48 hours.

Many Thanks - we know how much, we know it’s for BT we’ve asked BT they give us the debt agency, the debt agency they say they have no interest and so here we are on the CCJ merry- go- round……

Presumably the debt recovery agency have already been paid a fixed fee so is not minded to do any further work. Your son, as the account holder, should try the BT billing team again (an account number would help) as it seems ludicrous that a judgment creditor is refusing a genuine offer to settle the account and dig a bit deeper into its systems to facilitate that.

Unfortunately, the BT mods here no longer have account access so will be unable to help directly but I will flag the thread to them in case they can exert any leverage on the billing team.

I suspect the issue is that BT sold the debt on to the agency, rather than appointing them to recover it. Hence why BT now have no interest. Try the National Debtline for advice.

Alternatively, the account holder (the Defendant) could apply to the Court to have the jugment set aside which would activate the debt recovery company to respond and arrangements could then be made to settle the debt and arrange for a Certificate of Satisfaction to be issued.
