That Ofcom rule came into play in February 2020. Out of contract customers are also supposed to be contacted annually about the best deals available to them:

Anyone who is already out of contract must also be reminded they are out of contract, and told every year about their firm’s best deals.

If this definitely didn't happen then there are grounds for complaint, at least for the last three years.

But coming back to the topic, migrating to a new email address (preferably also another for business) really isn't as painful as it might seem.
