According to openreach my property is capable of recieving broadband at speeds of upto 80mbps yet BT only offer 40-45mbps why is this

Both are just estimates, you won't know what actual speed is possible until service is provided.
All FTTC lines are capable of UP TO 80Mb/s but actual speed is dependent on distance from the cabinet.
