Im surprised that the earlier engineers didn't point out the tree but if its your tree and it has damaged the line, I would have thought it was your problem.

Or was the line installed 'around' the tree ?

If its on your land then I think then any damage is your responsibility ? It sounds as if the line has been stretched, which would very likley cause the problems with phone and internet.
Fingers crossed, but you need a new line.

BTW, they call it fibre when the last bit to the house is still copper as it means fibre to the street cabinet.
